Introduction
You agree that by registering a user profile on Locodels, you are entering into a legally binding agreement with Locodels. Furthermore, you agree that by using the Service, you agree to those provisions of this document which concerns the content on the Service and your conduct thereon.
If you do not want to use the Service and be bound by the provisions of this Agreement, do not register as a User. If you have already registered, but would like to terminate your account, contact Locodels at hi [@] locodels.com.
Locodels reserves the right to amend the Agreement at any time. The change will be effective immidiately.
The User enters into this agreement regarding the use of the Locodels services with Locodels Ltd., an UK registered company with registration number 09708924.
Definitions
Agreement shall mean this document and any documents it refers to:
- Parties shall mean the User and/or Locodels
- Service shall mean the service of facilitating contact between Users of the Service (regardless of such service being provided via the web, mobile app, or through other means), Users shall mean all users of the Service
- Website shall mean the website on which the Service is provided.
The service
By entering into this Agreement, the User gets access to the Service as it is offered at any time. Locodels Ltd. is free to add, remove or change features or functionality of the Service.
Locodels contains a database of Users that are willing to do the delivery in exchange for a certain fee. Users that opted to do the delivery are matched with Users that opted need of the delivery service. Locodels serves as an interim partner that transfers funds from the Sender (User that needs a delivery) and a Deliverer (User that does the delivery).
Setting the order active and accepting it, Users enter into a direct agreement with each other and Locodels is not a contractual party to any such agreements entered into between users. Locodels merely supplies the medium for Users to connect with each other and to facilitate payments for services rendered.
While Locodels does tries to verify the identity of registered Users, the Service is dependent on the Users providing correct information. Locodels does not take any responsibility of the actions or omissions of any Users connecting via the Service. Locodels does not assume any responsibility for the accuracy or reliability of User provided information or any other information on the Service.
Communications
As a User of Locodels you agree to recieve communication from Locodels. This communication is related only to the Service.
Users
The User can be a physical or a legal person. All Users are required to register a profile in order to use the Service.
Locodels uses the information you provide to facilitate the contact between different Users of the Service so that a request can be handled by the Driver undertaking to perform the transportation service. Information that is set as mandatory needs to be filled in User details section.
All personal information is stored securely and treated in accordance with applicable legislation. You have the right to information about the data we have stored about you, and to demand that any errors are corrected. Further information regarding our use of personal information can be found in our privacy policy and which forms an integral part of this Agreement.
The User warrants and represents that all of the data provided by the User for registration is accurate and complete. The User shall report any changes in the registration data to Locodels without undue delay.
Usage rules
The User shall provide only accurate, true and non-misleading statements in the User profile. It is The User's responsibility to keep the information accurate and updated. The User shall comply with all applicable legislation and respect all third party rights. In particular, the User shall not use the Service to transport any prohibited goods or use the Service to violate any applicable laws. The User may report any activities of any other user which violate applicable laws and/or any of the terms and conditions of the Agreement by contacting Locodels. The Users are solely responsible for customs, legal and/or financial issues related to the transport of goods, including but not limited to issues arising out of cross border transports.
Locodels' obligations and liability
Locodels Ltd. endeavors to ensure that Service will be available at all times. However the User acknowledges and agrees that events related to maintenance, security or capacity requirements, and/or events beyond Locodels' control may result in brief malfunctions or temporary interruptions of the services provided on Locodels' website. Locodels Ltd. disclaims all liability for damages caused by any such interruption or errors in functioning.
Locodels only provides the platform on which Users can connect to enter into agreements directly with each other for the provision of transport services. Locodels takes no responsibility for the goods transported or for the performance of the transport service itself.
Locodels does not make any warranties or representations regarding any data and/or information published or otherwise made available on the Service or on any external websites linked to or referred to on the Service.
Locodels is not responsible for any indirect losses.
Indemnification
By providing information to Locodels, you represent and warrant that you are entitled to submit the information and that the information is accurate, not confidential, and not in violation of any contractual restrictions or other third party rights.
You shall indemnify and hold Locodels harmless for all damages, losses and costs related to all third party claims, charges, and investigations, caused by (1) your failure to comply with this Agreement, including, without limitation, your submission of information that violates third party rights or applicable laws or your failure to comply with the usage rules, (2) any information you submit to the Services, and (3) any activity in which you engage on or through the Service.
Locodels makes all reasonable efforts to verify the identity of registered Users. However, Locodels explicitly disclaims any liability in connection with Users who submit inaccurate or incorrect information. The User warrants and shall indemnify and hold harmless Locodels for any loss due to inaccurate or incorrect information being submitted by the User, or the registered profile being used by someone else than the registered User.
Privacy policy
When registering with Locodels you agree that Locodels may use the information provided by you within the boundaries set by applicable law. The information will be stored and used by Locodels to in order for the Service Provider to perform its service and to manage and maintain the relationship with the User.
Locodels may contact you at the email address specified in your profile with information about services and new offers from Locodels.
You have the right to request access to the information we have stored about you as well as requesting that we correct any erroneous information we have stored about you. For any queries regarding our use of personal data, please contact Locodels at hi [@] locodels.com.
Intellectual property rights
Locodels shall retain any and all intellectual property rights to all features and content of the Service, including but not limited to pictures, video, audio, text, design elements and source code. The User is granted a royalty-free (subject to any fees for accessing the Service being paid), non-exclusive, non-transferrable license to use the Service in accordance with this Agreement throughout the term of the Agreement.
Pricing system and payment
The price consists of two elements, fixed fee for the User's region and price per kilometer in the User's region.
The final price for the service is determined by the Sender.
Sender pays the price using the PayPal.
Deliverer is payed weekly on Mondays for the past 7 days. After VAT deduction and PayPal payment fees, Deliverer is payed 70% of each delivery.
Termination due to breach
Locodels may restrict, suspend or terminate the account of any User who abuses or misuses the Services or if the User violates the Agreement, without further notice to the User.
Disputes, Choice of law and jurisdiction
This Agreement between you and Locodels shall be governed by and construed in accordance with the laws of UK. Any dispute shall be subject to the exclusive jurisdiction of English court.
Privacy Policy
To be able to provide the Service, Locodels will process contact information and other personal data about the Users of the Service.
Controller for personal data is Locodels Ltd., 20-22 Wenlock Road, London N1 7GU, England. Registered in England and Wales with company registration number 09708924.
All Users are required to register a profile in order to use the Service. The User can be a physical or a legal person. The information will be used by Locodels to perform its Service and to manage and maintain the relationship with the User. The information is also used to take reasonable measures to verify the identity of Users. Locodels may contact User at the email address specified in your profile with information about services and new offers from Locodels. Personal data is collected directly from the User. By providing the personal data the User consents to Locodels' processing of the data according to the General Terms and Conditions and this Privacy Policy. Personal data will be disclosed to the extent necessary to facilitate contact between different Users of the Service so that a request can be handled by the Deliverer undertaking to perform the transportation service. Personal data will not be disclosed to third parties. Users are obliged to keep information accurate and complete. The User shall report any changes in the registration data to Locodels without undue delay. Upon termination of the Agreement Locodels will delete all personal data, unless storage is required by law or necessary to complete a transaction in accordance with the Agreement. Locodels has implemented technical and organizational measures to protect personal data against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access. The Service may use cookies to provide some of the functionality included in the Service.
Refund Policy
Locodels Ltd. refunds all PayPal charges that are related to potential technical errors in the Locodels' system. User requesting refunds should mail us at hi [@] locodels.com, stating the problems and the relevant order id. Refunds are issued at the discretion of the company management within 30-days period after date of order. In your claim, please, include explanation of reasons for a refund, and your order information.
